Your contract with us
–Terms and Conditions
“I”, “me” and “my”
refers jointly and severally to the person or persons who are the hirers. “This
agreement” means the Rental Invoice, the Insurance Motor Rental Agreement,
these Terms and Conditions, and the “Important Information” which follows. In
the event of any discrepancy between this agreement and any other Custard
Campers literature, the provisions of this agreement apply.
“Custard Campers”
means Custard Campers 12 The Priory,
Writtle, Chelmsford, Essex, CM1 3JE
The “company” means Custard
Campers.
“Equipment” includes
all those items listed under the heading Equipment List, given at time of
booking.
“Rental period” means
the rental period referred to under the heading ”Booking details” on the Rental
Invoice, and any additional period during which the vehicle remains in the
customer’s possession or control.
“Vehicle” means the
vehicle described under the heading “Vehicle Details” on the Insurance Motor
Rental Agreement and includes tyres, tools, accessories, equipment, documents
relating to the vehicle and any replacement or substitute vehicle which may be
provided at the discretion of Custard Campers.
“Security Deposit”
means a £500 deposit which is fully returnable when the vehicle is returned at
the end of the rental period in exactly the same condition as it was at the
start of the rental period. Costs of fuel, valeting, damage repair or insurance
excess in the event of a claim, will be deducted from this deposit before
returning it to the customer.
“The hirer” means any
person or persons authorized to drive the vehicle, and /or the person or
persons paying for the hire of the vehicle and equipment if they are not
authorised drivers.
“Driver” and
“drivers” means any person or persons authorised to drive the campervan during
the rental period
“Insurance” means
fully comprehensive insurance provided for authorised drivers.
Important information
1. What is
included in the hire?
The vehicle and equipment for
the period of hire (see the EQUIPMENT LIST for a full
list of equipment included). Note, tea
towels are included, other towels are not.
The picnic hamper does not include any saucepans.
Unlimited mileage in
the UK. We are unable to provide cover for travel to Ireland and Europe.
Fully comprehensive
vehicle insurance – see below.
AA membership –
breakdown and roadside assistance, tow to garage or back to us if necessary.
2. Insurance
Notwithstanding
anything contained herein to the contrary it is hereby understood and agreed
that this insurance covers the insured vehicle whilst let out on hire, subject
to the following conditions: -
2.1) The Insured shall verify the identity and
permanent address of the Hirer and any other permitted driver by means other
than relying solely on the information contained in the Hirer’s or driver’s
driving licence and that such person is not amongst the excluded persons
enumerated below.
2.2) The Insured Vehicle shall not be let out
on hire to or be driven by: -
a) Hirers under 25 or over 70 years of age
unless otherwise agreed by the Insurer.
b) Hirers aged 25 or over unless a full
driving licence valid in the United Kingdom has been held for 12 months.
c) Persons who have been convicted of an
offence in connection with the driving of a motor vehicle or motorcycle and/or
have had their driving licence endorsed or suspended or penalty points imposed.
Parking and not more than two speeding offences in the past 3 years may be
ignored. “Spent” convictions, covered by
the Rehabilitation of Offenders Act 1974 may be disregarded.
d) Persons who have any mental or physical
defect or infirmity or suffers from fits, diabetes or any heart complaint.
e) Persons who have had their insurance
declined and/or renewal refused and/or special insurance terms imposed as a result of claims experience
and/or have had their insurance or cover cancelled by any Motor Insurer.
f) Persons engaged wholly or partly in
professional entertainment or professional sports persons.
g) Jockeys and persons connected with
racing of any sort.
h) Undergraduates and/or students under 25
years of age.
i) Persons who, whilst driving, have been
involved in more than one accident during the past 3 years.
j) Foreign Service Personnel other than
persons born in the United Kingdom.
2.3) The insured vehicle shall be driven only
by the Hirer or other permitted driver who has completed and signed a Hirer’s
Proposal Form immediately prior to any hiring.
2.4) The Insurer’s form of proposal for Hirer
Drive insurance or as otherwise may be specifically agreed shall be completed
and signed by each Hirer or other permitted driver. Such proposal shall be forwarded immediately
to the Insurers. The proposal must be
fully completed by the Hirer or other permitted driver in all respects. In addition to the usual declaration and
warranty contained in the proposal, the following declaration shall appear on
the proposal, namely: -
If the statements and
particulars in the proposal are in the handwriting of any person other than the
Hirer or other permitted driver, such person shall be deemed to have been the
Hirer’s or other permitted driver’s agent for the purpose of completing the
proposal form.
2.5) The Insured shall be considered as the
being the agent for the Hirer or other permitted driver for all purposes in
connection with this insurance but under no circumstances shall the Insured be
considered as agent for the Insurers.
2.6) The Insured vehicle shall not be used for
the carriage of goods of an explosive, dangerous or hazardous nature or for the
carriage of goods or passengers for hire and reward or any other form of profit
or remuneration.
Subject otherwise to
the terms, exceptions and conditions of this insurance Included in the hire is
fully comprehensive insurance for drivers between the ages of 25 and 70 with
full, clean, UK or EU driving licenses, who have not made more than one “at
fault” claim in the past three years on any motor insurance. Drivers who
do not meet these criteria may still be insured, but there may be an additional
premium or excess – please ask us for a quote. The standard excess on the
policy is £500 for which the hirer of the vehicle will be liable if a claim is
necessary.
3. Driver Restrictions
Drivers must be
between 25 and 70 years of age.
Drivers must hold and
have held a full valid UK or EU driving licence for the past 2 years
Drivers must not have
made more than 1 “at fault” claim on any motor insurance policy in the last 3
years.
Proof of identity
must be provided for each driver prior to the start of hire.
This must include their photocard driving licence and paper counterpart, and
proof of address (utility bill or bank statement less than 3 months old)
It may be possible to
provide insurance for drivers who do not fully comply with these conditions.
Please discuss this with us at the time of booking and we will obtain a quote
from our insurance company.
Damage to tyres is
excluded from the insurance cover and the hirer will be fully responsible for
the replacement of damaged tyres.
4. No Smoking
Custard Campers
operate a no smoking policy in any of our vehicles. Smoking is not permitted inside the vans at
any time. If on return of the vehicle it
there is evidence of this having been ignored we reserve the right to deduct a
cleaning fee from the security deposit.
5. Booking and
deposit
Upon receipt of
an on- line booking form, we will confirm availability and arrange payment of
your deposit. Provisional bookings will be reserved for one week pending
receipt of a non-refundable deposit. The deposit required is £100 for a short
break or week-end booking, and £250 per week for longer bookings.
Payment can be made
by cheque or by electronic funds transfer. Payment of the balance is normally 6
weeks before the hire begins. In the case of late bookings, cleared funds must
be received before the hire begins.
6. Security Deposit
A security deposit of
£500 is required in case of damage to the vehicle, either externally or to the
interior. If damage has occurred an
estimate of the works required will be deducted from the security deposit. In the
event of an accident the security deposit will be used to cover the excess on
the insurance policy as stated in term 2 above.
The security deposit
must be paid into our account & be cleared funds prior to the commencement of hire.
7. Collection
and Return
Collection of the
vehicle is at 2.30pm on the first day of your holiday, and return is at 11am on
the last day of hire. In the case of one
day hire, pick up is from 8am and return by 9pm.
Please allow at least
one hour for the collection and return of your camper van. Before you leave us
we need to give you a demonstration of all the features of your camper, and
there are a few forms to fill in for insurance and other purposes.
We will provide you
with a full tank of petrol at the start of your holiday, and we ask that you
return the camper with a full tank at the end. (Our campers run on unleaded
petrol!)
You can park your car
at our premises while you are away, entirely at your own risk. Please leave your keys with us in case we
have to move vehicles around.
Please advise us if
you are going to be late returning the vehicle. This can give us problems
getting the vehicle ready for the next hire, and you may be driving uninsured.
We realise that sometimes delays are not your fault, but we reserve the right
to charge £50 per hour for late returns.
Please return the
vehicle clean, and in the same good condition that it was in when you collected
it from us. If the vehicle needs more
than routine cleaning we will charge a valeting fee of £100.

9. Cancellation
In the event of
cancellation more than 6 weeks prior to the start of the hire, the non- refundable
deposit will be retained by us but you will not be liable for any further
costs. We are not under any obligation to transfer deposits to alternative
booking dates, but will endeavour to do so where possible. Within 6 weeks of
the hire commencement date, the full hire charge will be payable.
In the event that
Custard Campers need to cancel the booking, all paid monies will be returned.
Any cancellation will be notified as soon as possible, and any cancellation is
not subject to any consequential losses incurred by the hirer.
10. Optional
extras
We offer various
optional extra services, including campsite booking service, food hampers,
awning hire, airport or station
collection service, and any other additional service or items agreed. Charges
for these items are quoted on request and subject to availability.
